What is the Fair Use Policy?

FUP (Fair Use Policy) refers to the rules that apply to roaming within the European Union, defining when roaming services can be used under the same conditions as in Poland.

EU roaming is intended primarily for people who travel occasionally and normally reside in Poland. If you use roaming in this way, you can travel freely within EU countries without worrying about additional charges (in accordance with the terms of your offer).

The European Union allows you to use your phone in EU countries “like at home”, but only if roaming is not used on a permanent basis and does not replace domestic use.

How does the Fair Use Policy work?

The Fair Use Policy (FUP) helps determine whether EU roaming is used mainly while travelling, rather than as a permanent way of using services outside Poland.

In practice, the operator checks, among other things, whether:

    • your number connects more often to networks in Poland than to foreign roaming networks,
    • you use services more frequently in Poland than in the Euro Zone,
    • the number is not used mainly abroad for a prolonged period of time.

The standard monitoring period is 4 months.

FUP does not apply to short trips or tourist travel, which usually last a few days or weeks. It becomes relevant in the case of longer stays abroad, for example when working or living outside Poland for several months.

What may result in additional charges?

Additional charges may be applied if:

    • during the 4-month period, your number logs into EU roaming networks more often than into networks in Poland, or roaming usage is higher than domestic usage,
    • you use multiple SIM cards consecutively while roaming,
    • SIM cards are used in a way that is inconsistent with their intended purpose, for example as part of organised resale to people who do not live in Poland and do not have stable ties to the country.

Before additional charges are applied, you will receive an SMS notification and will have two weeks to change your usage pattern.

If the usage balance does not change, the additional charges will be activated and will remain in place until you return to standard usage (i.e. using services more often in Poland than in roaming).

What happens if additional charges are applied?

If additional charges resulting from the Fair Use Policy are applied to your number, they will:

    • be charged from your available balance,
    • not reduce the data allowance included in your plan.

What are the additional charges?

The amount of additional charges is in line with the applicable price list and amounts to:

    • PLN 0.09 per minute for outgoing voice calls,
    • PLN 0.01per minute for incoming voice calls,
    • PLN 0.01 per SMS sent,
    • PLN 0.01 per MMS sent,
    • PLN 5.82 per 1 GB of data transmission.
