Mobile network operators should not obtain copies of identity documents to verify personal data during the prepaid SIM card registration process – this is the firm stance taken by the General Inspector for Personal Data Protection.
Changes to the Telecommunications Law, which came into effect on July 25th, imposed an obligation on prepaid SIM card users to register them. The organization of the entire registration process, ensuring it is secure and convenient for prepaid card users, was left to the mobile network operators.
The possibility of accepting scans or photocopies of identity documents for personal data verification raised doubts among telecommunication companies, lawyers, and users alike in the new regulations. Mobile Vikings, since the new regulations came into force (July 25th), has acted in accordance with the letter of the law and the interpretation of the vast majority of lawyers, despite the temptation to make the registration process easier for users.
Our stance is now confirmed by an official statement from the General Inspector for Personal Data Protection and the Office of Electronic Communications. It states that "Telecommunication companies should not obtain copies of identity documents for the purpose of registering prepaid SIM cards," which is clearly defined by Article 60b, paragraph 1, point 1 of the Act of July 16, 2004 – Telecommunications Law. Therefore, electronic registration, where you provide us with your data and send a scan of your ID to confirm it, is not possible.
The GIODO and UKE decided to issue an official statement on this matter due to signals they received about irregularities related to the unauthorized acquisition of data, which could lead to abuse. Therefore, let's be vigilant, protect our data, and not share copies of our identity documents.
